Forced buyers to evaluate the maximum penalty of 20,000

"Buying unreasonable goods, the buyer gave a "middle assessment" or "bad review". Internet transactions are "non-meeting transactions," and the asymmetry of information can easily lead to counterfeiting and selling, and consumer rights protection is difficult. Hangzhou has recently introduced the first domestic government regulations for online transactions - "Interim Measures for the Administration of Online Trading in Hangzhou." From May 1, sellers, buyers, and third-party online trading platforms will have to issue tickets if they want to do whatever they want.

Online shop also has to disclose business license

According to the 2014 Hangzhou 3·15 Consumer Rights Protection Report, in 2014, Hangzhou received a total of 22,334 off-site shopping complaints based on online shopping, an increase of 65.63% over the same period of the previous year.

What should I do if I have problems with online shopping? Zhang Mao, director of the State Administration for Industry and Commerce, once said that when he talked about the issue of counterfeit online shopping, online trading was not an extranet, and the e-commerce platform was responsible.

The “Interim Measures for the Administration of Online Trading in Hangzhou” clearly stipulates that operators engaged in online transactions should apply for industrial and commercial registration according to law. If the business is conducted through a third-party online trading platform, the business registration information shall be submitted to the third-party online trading platform.

Natural persons who do not yet have the conditions for industrial and commercial registration, who engage in online trading operations, should go through a third-party online trading platform and submit information such as identity certificates, business addresses, and contact information to third-party network trading platforms. Otherwise, the market supervision and administration department shall order the platform operator to correct within a time limit, and may impose a fine of more than 10,000 yuan but less than 30,000 yuan.

The operators of third-party online trading platforms shall review the qualifications of the business entities of the online trading operators entering the platform for selling goods or providing services, and shall find that the network trading operators conceal the truth, provide false or invalid business entity qualification information, and Stop providing platform services immediately.

Consumers who have disputes with online trading operators may require mediation by third-party network trading platform operators. The platform operator shall handle it within 7 working days from the date of receiving the consumer’s request. If disputes occur, electronic shopping vouchers or service documents, transaction exchange records, etc., can also serve as credentials for handling online consumer disputes.

No eight activities can be engaged in online transactions

Online shop cheats are endless. Before online shopping, people often point to other customers' reviews for reference, but are reviews true?

In the past, bad reviews were given after online shopping, and many people encountered harassment from shop owners. The Interim Measures also stipulates that online trading operators must not harass or threaten consumers in any way and force them to make or modify goods or service evaluations against their will. If harassing or threatening consumers and forcing them to make or modify the evaluation of goods or services contrary to their wishes, they shall be ordered to make corrections and impose a fine of 2,000 yuan up to 20,000 yuan.

In addition, if the online trading operator carries out sales promotion, the published promotion information shall clearly indicate the scope, price, and quantity of the promotion method, rules, deadlines, and promotional goods or services. Promotions that do not include all goods or services may not be advertised as a whole. Promotional information may not be arbitrarily changed during the promotional period; when the promotional item is sold out, it shall be clearly indicated immediately.

The publication of promotional information that does not meet the requirements, mislead consumers, or arbitrarily change promotional information during the promotion period and damages the interests of consumers will be ordered to correct and impose a fine of 10,000 yuan up to 30,000 yuan.

The "Provisional Measures" also stipulates that the following eight types of activities may not be engaged in online transactions:

- Unauthorized use of well-known websites, well-known online shops, domain names, names and logos of well-known applications, or use of domain names, names, and logos similar to well-known websites, well-known online shops, and well-known applications, to be confused with others;

- unauthorized use or falsification of government departments or social groups;

- Maliciously evaluating or smashing merchandise sold or services provided by others, or making false complaints or reports;

- Malicious implementation of bulk purchases after the bulk purchase or rejection of receipts, to the detriment of the interests of others;

- Fictitious Internet transactions, knowing or should know to facilitate the conduct of fictional transactions;

- Use technical means to interfere with search and ranking results; publish false goods and service information; and other acts that harm national interests, public interests, and the legitimate rights and interests of others.

If the above provisions are violated, the market supervision and management department will order corrections and impose a fine of 10,000 yuan up to 30,000 yuan.
